Onward Transfer and Consent to International Processing

. Meet Fit Singles is a growing company with users and operations in multiple countries. Meet Fit Singles has developed data practices designed to assure information is appropriately protected but cannot always know where information may be accessed or processed. Meet Fit Singles may transfer Personal Information or other information to Meet Fit Singles offices outside of the United States. In addition, Meet Fit Singles may employ other companies and individuals to perform functions on its behalf. Advertising Opt-Out

How Do You Choose What Information We Collect and Use?

When you choose to provide your information, including Personal Information, to Meet Fit Singles, you consent to the use of your information as identified in this Policy and as may be further identified at the time of collection. You may notify Meet Fit Singles at any time that you wish to withdraw or change your consent to Meet Fit Singles' use and disclosure of your information, and Meet Fit Singles may make reasonable efforts to accommodate any such request, subject to applicable legal, contractual, and business considerations and restrictions.

Data Security

Meet Fit Singles has implemented measures designed to prevent unauthorized access and use of your information, including Personal Information. The safety and security of your information also depends on you. You are responsible for keeping any passwords for the Service confidential and secure. No data transmissions through the Internet or via mobile devices, or even the physical transfer of information, can be guaranteed to be completely secure. Meet Fit Singles does not ensure or warrant the security of any data or information you transmit to Meet Fit Singles pursuant to the Service or otherwise, and you do so at your own risk. Further, Meet Fit Singles is not responsible for circumvention of any privacy settings or security measures. You agree that Meet Fit Singles may communicate with you electronically regarding security, privacy, and administrative issues, such as security breaches. Meet Fit Singles may post a notice on the Service if a security breach occurs or may send an email to you at the email address you have provided for the Service.

Children's Privacy

Although the Service is a general audience website and mobile application, Meet Fit Singles restricts the use of the Service to individuals age 18 and above, and does not knowingly collect Personal Information or any other information from children under the age of 18. If Meet Fit Singles learns it has collected or received Personal Information (or other information subject to the

Children's Online Privacy Protection Act

) from a child under 18 without verification of parental consent, Meet Fit Singles will delete that information. If you believe Meet Fit Singles might have any information from or about a child under 18, please contact Meet Fit Singles in the manner provided at the end of this Policy.

Your California Privacy Rights

The provisions contained in this section (Your California Privacy Rights) apply to you only if you are a California resident. This section is intended to comply with the California Consumer Privacy Act of 2018 ("CCPA") and any terms defined in the CCPA have the same meaning when used in this section. Pursuant to the CCPA, this section must be reviewed and updated by Meet Fit Singles at least every 12 months. The provisions of this section were last reviewed on _______________________, 2020.

Meet Fit Singles obtains the categories of personal information listed above from the following categories of sources: (i) directly from you (e.g., from forms you complete or products and services you purchase) and (ii) indirectly from you (e.g., from observing your actions on the Service).

Meet Fit Singles may use, sell, or disclose the personal information it collects for one or more of the purposes described in the section of this Policy titled "How Do We Use Information?" Meet Fit Singles may disclose your personal information to a third party for a business purpose or sell your personal information, subject to your right to opt-out of those sales. When Meet Fit Singles discloses personal information for a business purpose, Meet Fit Singles enters a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. The CCPA prohibits third parties who purchase the personal information Meet Fit Singles holds from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales. Meet Fit Singles may share or sell your personal information with the following categories of third parties: (i) service providers; (ii) data aggregators; (iii) affiliates; (iv) partners; (v) parent or subsidiary organizations; (vi) internet cookie data recipients, like Google Analytics; (vii) advertising networks; (viii) internet service providers; (ix) data analytic providers; (x) government entities; (xi) operating systems and platforms; and (xii) social networks.

In the preceding 12 months, Meet Fit Singles has sold the following categories of personal information: Category A: Identifiers; Category B: California Customer Records personal information categories; Category C: Protected classification characteristics under California or federal law; Category D: Commercial information; Category E: Biometric information; Category F: Internet or other similar network activity; Category G: Geolocation data; Category H: Sensory data; Category I: Professional or employment-related information; Category K: Inferences drawn from other personal information.

The CCPA provides consumers who are California residents with specific rights regarding their personal information. You have the right to request that Meet Fit Singles disclose certain information to you about its collection and use of your personal information over the past 12 months. Once Meet Fit Singles receives and confirms your verifiable consumer request, Meet Fit Singles will disclose to you the following: (i) the categories of personal information Meet Fit Singes collected about you; (ii) the categories of sources for the personal information Meet Fit Singles collected about you; (iii) Meet Fit Singles' business or commercial purpose for collecting or selling that personal information; (iv) the categories of third parties with whom Meet Fit Singles shares that personal information; (v) the specific pieces of personal information Meet Fit Singles collected about you (also called a data portability request); and (vi) if Meet Fit Singles sold or disclosed your personal information for a business purpose, two separate lists disclosing: (A) sales, identifying the personal information categories that each category of recipient purchased; and (B) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

You have the right to request that Meet Fit Singles delete any of your personal information that Meet Fit Singles collected from you and retained, subject to certain exceptions. Once Meet Fit Singles receives and confirms your verifiable consumer request, Meet Fit Singles will delete (and direct its service providers to delete) your personal information from its records, unless an exception applies. Meet Fit Singles may deny your deletion request if retaining the information is necessary for Meet Fit Singles or its service providers to do any of the following: (i) complete the transaction for which it collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of an ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform a contract with you; (ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; (iii) debug products to identify and repair errors that impair existing intended functionality; (iv) exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law; (v) comply with the California Electronic Communications Privacy Act (Cal. ); (vi) engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent; (vii) enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with Meet Fit Singles; (viii) comply with a legal obligation; (ix) make other internal and lawful uses of that information that are compatible with the context in which you provided it.

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to Meet Fit Singles in the manner provided at the bottom of this Policy. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (i) provide sufficient information that allows Meet Fit Singles to reasonably verify you are the person about whom Meet Fit Singles collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows Meet Fit Singles to properly understand, evaluate, and respond to it. Meet Fit Singles cannot respond to your request or provide you with personal information if Meet Fit Singles cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with Meet Fit Singles. Meet Fit Singles will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. Meet Fit Singles endeavors to respond to a verifiable consumer request within 45 days of its receipt. If Meet Fit Singles requires more time (up to 90 days), Meet Fit Singles will inform you of the reason and extension period in writing. If you have an account with Meet Fit Singles, Meet Fit Singles will deliver its written response to that account. Otherwise, Meet Fit Singles will deliver its written response by mail or electronically, at your option. Any disclosures Meet Fit Singles provides will only cover the 12-month period preceding the verifiable consumer request's receipt. The response will also explain the reasons Meet Fit Singles cannot comply with a request, if applicable. For data portability requests, Meet Fit Singles will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. Meet Fit Singles does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If Meet Fit Singles determines that the request warrants a fee, Meet Fit Singles will tell you the basis for that decision and provide you with a cost estimate before completing your request.

If you are 16 years of age or older, you have the right to direct Meet Fit Singles to not sell your personal information at any time (the "right to opt-out"). Meet Fit Singles does not sell the personal information of consumers it actually knows are less than 16 years of age. You do not need to create an account with Meet Fit Singles to exercise your opt-out rights. Meet Fit Singles will only use personal information provided in an opt-out request to review and comply with the request.

Meet Fit Singles will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, Meet Fit Singles will not: (i) deny you goods or services; (ii) charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; (iii) provide you a different level or quality of goods or services; or (iv) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. However, Meet Fit Singles may offer you certain financial incentives permitted by the CCPA that can result

in different prices, rates, or quality levels. Any CCPA-permitted financial incentive offered will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

California's "Shine the Light" law (Civil Code Section - 1798.83) permits users of the Service that are California residents to request certain information regarding Meet Fit Singles' disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please contact Meet Fit Singles in the manner provided at the bottom of this Policy.

Changes to This Policy

This Policy may change from time to time at the discretion of Meet Fit Singles without notice to you and without your consent. Terms and Conditions

This Terms of Use Agreement ("Agreement") is applicable to the mobile application known as "Meet Fit Singles" and the website located at www.MeetFitSingles.com (the "Service"), and forms a binding contract between Meet Fit Singles, LLC, a Texas limited liability company (together with its successors and assigns, "Meet Fit Singles"), and the user of the Service (together with such user's administrators, executors, and heirs, "you"). The

("Privacy Policy"),

Arbitration Procedures

("Arbitration Procedures"), and any other terms disclosed or made available by Meet Fit Singles to you in connection with your use of the Service are incorporated by reference into this Agreement and form a part of this Agreement to the same extent as if set forth verbatim in the body of this Agreement. By downloading, registering for, accessing, or using the Service, you are accepting and agreeing to all of the terms of the Agreement. Please print and keep a copy of the Agreement for your records.

The Agreement may change from time to time at the discretion of Meet Fit Singles without notice to you and without your consent, and will become effective upon posting to the Service or otherwise being disclosed or made available to you. Your continued use of the Service after any changes are made to the Agreement shall be deemed to constitute your acceptance of those changes. It is your obligation to review the Agreement and to become aware of any modifications.

ELIGIBILITY

You must be 18 years of age or older to visit or use the Service in any manner. By visiting the Service or accepting the Agreement, you represent and warrant to Meet Fit Singles that you: (i) are 18 years of age or older, and that you have the right, authority and capacity to agree to and abide by the Agreement; (ii) will use the Service in a manner consistent with the Agreement and all applicable laws and regulations; and (iii) have not been convicted of any felony and are not required to register as a sex offender with any government authority.

RIGHT TO USE

Your right to use the Service is subject to the terms of the Agreement and any limitations, conditions, and restrictions established by Meet Fit Singles from time to time, in Meet Fit Singles' sole discretion, and you must abide by all of the terms of the Agreement and any such other limitations, conditions, and restrictions in order to become or remain an authorized user of the Service. Meet Fit Singles may alter, suspend, or discontinue any aspect of the Service at any time, including the availability of any Service feature, database, or content. Meet Fit Singles may also impose limits on certain features and aspects of the Service or restrict your access to parts or all of the Service without notice or liability and for any reason.

CODE OF CONDUCT

You agree to use the Service in strict compliance with the following code of conduct:

You will keep all information provided to you through the Service private and confidential, and will not give such information to anyone without the permission of the person who provided it to you.
You will not, directly or indirectly, use the Service to engage in any form of harassment or offensive behavior of any kind.
You will not, directly or indirectly, use the Service to infringe the privacy rights, property rights, intellectual property rights, or any other rights of any person.
You will not, directly or indirectly, use the Service in a manner that is fraudulent or otherwise unlawful.
You will not, directly or indirectly, use the Service to advertise or solicit goods, funds, or services of any kind.
You will not, directly or indirectly, disparage Meet Fit Singles, the Service, or any other users or members of the Service (collectively, "Members").

REMOVAL AND USE OF INFORMATION, INCLUDING PROFILES

Meet Fit Singles does not review all profiles, public postings, messages, information, or other materials posted or sent by Members and is not responsible for any of the content of these profiles, public postings, messages, information, or other materials. You agree, acknowledge, represent, understand, and warrant that: (i) once established, your profile cannot be deleted or removed, except as provided herein, and may still be accessible by other Meet Fit Singles Members if your account becomes inactive, (ii) profiles of other Meet Fit Singles Members may still be accessible even if such user is inactive, (iii) at any time, Meet Fit Singles reserves the right (but is not obligated) to delete, remove, move, or edit profiles, public postings, messages, information, and other materials that Meet Fit Singles, in its sole discretion, deems inappropriate, unacceptable, or in violation of the Agreement or any other applicable content guidelines, (iv) at any time following twelve (12) months of inactivity on your account, Meet Fit Singles may suspend, delete and/or remove your profile, (v) at any time after one year from first establishing a profile with Meet Fit Singles, you may request Meet Fit Singles to delete and remove your profile, provided that such request is in writing, and (vi) your profile, public postings, messages, information, and other materials you create, communicate, display, post, publish, submit, or transmit on or through the Service must comply with the standards and terms set out in the Agreement and will be considered non-confidential and non-proprietary, and you grant Meet Fit Singles and its affiliates and service providers, and each of the foregoing's respective licensees, successors, and assigns, the right to

such marks without the prior written permission of Meet Fit Singles. All other names, logos, product, and service names, designs, and slogans on the Service are the trademarks of their respective owners.

NO RESPONSIBILITY

Meet Fit Singles is not responsible for interruption or suspension of the Service, or any harm to you resulting therefrom, regardless of the cause of the interruption or suspension.

SECURITY

You are responsible for maintaining the confidentiality of your username, password, and other information used to access the Service. You are responsible for all usage or activity on the Service by users (including third parties) using your username, password, or account. You agree to immediately notify Meet Fit Singles of any unauthorized use of the Service under your name, password, or account.

MEET FIT SINGLES ALSO DOES NOT INQUIRE INTO THE BACKGROUNDS OF ALL OF ITS MEMBERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS MEMBERS. MEET FIT SINGLES MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS OR THEIR COMPATIBILITY WITH ANY CURRENT OR FUTURE MEMBERS. MEET FIT SINGLES RESERVES THE RIGHT TO CONDUCT ANY CRIMINAL BACKGROUND CHECK OR OTHER SCREENINGS (SUCH AS SEX OFFENDER REGISTER SEARCHES), AT ANY TIME AND USING AVAILABLE PUBLIC RECORDS, BUT SHALL HAVE NO OBLIGATION TO DO SO. YOU UNDERSTAND THAT MEET FIT SINGLES MAKES NO GUARANTEES, EITHER EXPRESS OR IMPLIED, REGARDING YOUR ULTIMATE COMPATIBILITY WITH INDIVIDUALS YOU MEET THROUGH THE SERVICE. YOU SHOULD NOT PROVIDE YOUR FINANCIAL INFORMATION (FOR EXAMPLE, YOUR CREDIT CARD OR BANK ACCOUNT INFORMATION) TO OTHER MEMBERS FOR ANY REASON. EXTERNAL RESOURCES

The Service may contain or make available links or other access to third party applications, sites, and resources ("External Resources"). You should review all the terms of use, privacy statements, and other applicable information regarding such External Resources prior to use. Meet Fit Singles does not make any representation or warranty, does not endorse, and does not assume and will not have any liability or responsibility to you or any other person for or in connection with any External Resources or for any other materials, products, or services of third parties, and you access or use the External Resources at your sole risk.

PAYMENT

Where payment is required for use of the Service or any features thereon, the following terms and conditions will apply.

Billing and Payment

Meet Fit Singles will use the credit card information you provide in your registration or other manner to bill you. You agree to be billed by Meet Fit Singles for the Service in advance or at any other time as Meet Fit Singles determines. It is your sole obligation to provide accurate and complete credit card information, and to timely update your account with any changes to such information. If you have a billing addresses outside Canada, you confirm that you are not a resident of Canada and are not registered for purposes of Canadian goods and services tax (GST) and harmonized sales tax (HST).

In App Purchases

From time to time, Meet Fit Singles may offer additional products and services for purchase ("in app purchases") through application platforms authorized by Meet Fit Singles. If you choose to make an in app purchase, you will be prompted to enter details for your account with the mobile platform you are using (e.g., Apple, Android, etc.) ("your IAP Account"), and your IAP Account will be charged for the in app purchase in accordance with the terms disclosed to you at the time of purchase as well as the general terms for in app purchases that apply to your IAP Account. If you purchase an auto-recurring periodic subscription through an in app purchase, your IAP Account will be billed continuously for the subscription until you cancel in accordance with the platform terms. In all cases, please refer to the terms of your application platform which apply to your in app purchases.

Automatic Renewal

Paid memberships for the Service are subscriptions. After your initial subscription commitment period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the current price for the Service or at the price you agreed to when subscribing, as determined by Meet Fit Singles. You agree that your account will be subject to this automatic renewal feature unless you opt out in the manner provided on the Service. By subscribing to the paid membership, you authorize Meet Fit Singles to bill the credit card you provided now and again for any subsequent subscription period. You also authorize Meet Fit Singles to charge you for any sales or similar taxes that may be imposed on your subscription payments. Your non-termination or continued use of the paid memberships reaffirms that Meet Fit Singles is authorized to charge the credit card information provided. Meet Fit Singles may submit those charges for payment and you will be responsible for such charges. This does not waive Meet Fit Singles' right to seek payment directly from you. Your charges shall be payable in advance unless otherwise determined by Meet Fit Singles.

Termination of Services for Non-Payment

If you fail to timely pay any amounts due for the Service for any reason, including because Meet Fit Singles is unable to charge your credit card for any reason, Meet Fit Singles may discontinue any and all of your access or use of the Service either temporarily or permanently and/or otherwise suspend, remove and/or delete your profile.

Cancellation of Services

If you cancel your account, your paid membership will be cancelled unless you used PayPal to complete your purchase. If you used PayPal to pay for your paid membership, you must contact or login to PayPal to cancel your account as Meet Fit Singles is not able to do this on behalf of PayPal users. Cancellation of Service does not automatically result in the deletion or removal of your profile. The terms governing the deletion and removal of your profile are set forth above in the paragraph entitled Removal and Use of Information, Including Profiles.

Refunds

Generally, all charges for purchases are nonrefundable, and there are no refunds or credits for partially used periods. Meet Fit Singles may make an exception if the laws applicable in your jurisdiction provide for refunds. For paid membership subscribers residing in the EU or European Economic Area, in accordance with local law, you are entitled to a full refund during the 14 days after the paid membership subscription begins. Please note that this 14-day period commences when the subscription starts. For paid membership subscribers residing in Arizona, California, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio and Wisconsin, the following terms apply: You may cancel the paid membership, without penalty or obligation, at any time prior to midnight of the third business day following the original date of the paid membership, excluding Sundays and holidays.

To request a refund: If you subscribed using your Apple ID, refunds are handled by Apple, not Meet Fit Singles. To request a refund, go to iTunes, click on Your Apple ID, select "Purchase history," find the transaction and hit "Report Problem". You can also submit a request at

. If you used PayPal, you must contact or login to PayPal to request a refund. YOU AND MEET FIT SINGLES AGREE THAT YOU OR MEET FIT SINGLES MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. NO CLAIM MAY BE CONSOLIDATED OR JOINED WITH MORE THAN ONE PERSON'S OR PARTY'S CLAIMS. NEITHER PARTY MAY JOIN ANY CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. You hereby agree to indemnify, defend and hold harmless Meet Fit Singles and all officers, managers, members, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of the Agreement or the foregoing representations, warranties and covenants, or your acts or omissions relating to the Service. You shall cooperate as fully as reasonably required in the defense of any such claim. Meet Fit Singles reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

CUMULATIVE REMEDIES

Except to the extent otherwise expressly provided in the Agreement, the rights and remedies provided to Meet Fit Singles under the Agreement shall not be exhaustive or exclusive, but shall be cumulative of each other and in addition to any other rights and remedies available under contract, equity, or law.

ARBITRATION

The exclusive means of resolving any dispute or claim arising out of or relating to the Agreement or the Service shall be

, and the arbitrator shall determine all issues regarding the arbitrability of the dispute. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons. Any proceeding to enforce this paragraph or the Arbitration Procedures, including any proceeding to confirm, modify, or vacate an arbitration award, may be commenced in any court of competent jurisdiction. In the event that, contrary to the parties' intent, the foregoing provisions of this paragraph or the Arbitration Procedures are for any reason held to be unenforceable, any litigation against Meet Fit Singles may be commenced only in the federal or state courts located in Dallas County, Texas. You hereby irrevocably consent to the jurisdiction of those courts for such purposes.

GOVERNING LAW

The Agreement, and any dispute between you and Meet Fit Singles, shall be governed by the laws of the state of Texas without regard to principles of conflicts of law, provided that the Arbitration Procedures shall be governed by the Federal Arbitration Act.

MISCELLANEOUS

TheAgreement (including t

he Privacy Policy and Arbitration Procedures)

, constitute the sole and entire agreement between you and Meet Fit Singles regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service. You confirm that you have not received or relied on any agreements, covenants, representations, or warranties regarding the Services except for those expressly set forth in the Agreement.

No waiver by Meet Fit Singles of any

or condition set out in the Agreement shall be deemed a further or continuing waiver of such

or condition or a waiver of any other

or condition, and any failure of Meet Fit Singles to assert a right or provision under the Agreement shall not constitute a waiver of such right or provision.

If any provision of the Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Agreement shall otherwise remain in full force and effect and be enforceable. You may not assign, transfer or sublicense the Agreement without the prior written consent of Meet Fit Singles. Meet Fit Singles may assign the Agreement in whole or in part. No agency, partnership, joint venture, or employment is created as a result of the Agreement. All notices under the Agreement shall be in writing and shall be deemed to have been duly given when receipt is electronically confirmed, if transmitted by facsimile or email or upon receipt, if sent by certified or registered mail, return receipt requested. Unless the context clearly requires otherwise: (i) the gender (or lack of gender) of all words used in the Agreement, including defined terms, includes the masculine, feminine, and neuter form; (ii) the number of all words used in the Agreement, including defined terms, includes the singular and plural; (iii) when used in the Agreement, the term "including" means "including without limitation"; (iv) references in the Agreement to "persons" means "legal persons"; (v) references to currency and monetary values set forth in the Agreement shall be to United States dollars; (vi) the captions and headings in the Agreement have been included for convenience only, are not part of the Agreement, and shall not be used to interpret the Agreement; and (vii) the Agreement shall be construed as a whole, according to fair meaning, and not in favor of or against any person, including by virtue of authorship.
